Unlike what many others have said, Kird Ape is not restricted or banned or anything. It is completely legal. It got promoted to mythic because it used to be banned, then they changed their minds. By being a famous banned card, and becoming completely legal, it was reprinted as a mythic in From the Vaults. If they ever reprint this card in a normal set, it would not be mythic, probably an uncommon.

This card isn't Mythic for its actual power level. It's Mythic because it's in this special "From the Vault: Exiled" set; and it's in this set because of what it was - and what people thought it was - back in its heyday.
As its flavor text says - context is everything. ;)
