Wow, one of the few cards able to claim to be strictly worse than another (barring type). Same size and cost, both fly, but this has a more strict upkeep cost. Congratulations, Waterspout Djinn, you can claim to be strictly worse than Living Tsunami. A rare honor in magic :)

Most times when a player takes control of something, they have a choice on what to take control of. I wouldn't steal a creature which would return to hand the next upkeep because I couldn't pay costs.
